Terms and Conditions for Providers (Psychologists and Psychiatrists) on MindOk (A product of Advertia Pvt Ltd)
1. Introduction These Terms and Conditions ("Agreement") govern the relationship between Advertia Pvt Ltd ("Company," "we," "us," or "our") and the psychologists and psychiatrists ("Providers," "you," or "your") who register to offer their services on the MindOk platform. By registering as a Provider on www.mindok.in ("Platform"), you agree to comply with these terms. If you do not agree with any part of these terms, you must refrain from registering and using our services.
2. Registration and Account
- Eligibility: To register as a Provider on MindOk, you must hold a valid license to practice psychology or psychiatry in your jurisdiction. You are required to provide accurate, complete, and up-to-date information during the registration process.
- Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or breach of your account.
3. Professional Conduct: As a Provider, you agree to conduct yourself in a professional, ethical, and lawful manner while using the Platform. You must adhere to all relevant professional codes of conduct, ethical guidelines, and legal requirements in your practice.
- Service Quality: You are expected to provide high-quality mental health services to Patients using the Platform. This includes being punctual for sessions, maintaining a professional demeanor, and providing services that align with the descriptions and qualifications you have listed on the Platform.
- Compliance with Laws: You agree to comply with all applicable laws, regulations, and licensing requirements in the delivery of your services. You are solely responsible for ensuring that your practice and services comply with all legal standards.
4. Fees and Payment
- Platform Fees: MindOk may charge a service fee or registration fee or commission on the payments you receive from Patients through the Platform. The applicable fee structure will be communicated to you during the registration process and may be subject to change with notice.
- Payment Processing: All payments from Patients are processed through third-party payment processors. You agree to provide accurate banking information for the transfer of funds. Advertia Pvt Ltd is not responsible for the wrong bank information given by the providers. Advertia Pvt Ltd is not responsible for any delays or issues in payment processing caused by third-party services.
5. Confidentiality and Privacy
- Patient Confidentiality: You are required to maintain the confidentiality of all Patient information obtained through the Platform, in accordance with applicable laws and ethical guidelines. You agree to use Patient information solely for the purpose of providing mental health services and not for any other purpose.
- Data Security: Advertia Pvt Ltd is committed to protecting the privacy and security of your personal information as well as the information of the Patients. You are expected to implement appropriate safeguards to protect the confidentiality and integrity of any data you collect or store.
6. Termination
- Voluntary Termination: You may terminate your account at any time by providing written notice to us. Upon termination, your profile will be removed from the Platform, and you will no longer be able to offer services through MindOk.
- Termination by Company: Advertia Pvt Ltd reserves the right to terminate or suspend your account at any time, with or without notice, for any reason, including but not limited to breach of these terms, unethical conduct, or legal violations.
7. Limitation of Liability Advertia Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including but not limited to loss of income, loss of business opportunities, or any other damages.
8. Governing Law This Agreement shall be governed by and construed in accordance with the Indian Laws of Kolkata High Court, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Kolkata, West Bengal for the resolution of any disputes arising out of or related to this Agreement.
9. Changes to Terms Advertia Pvt Ltd reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to you via email or through the Platform. Continued use of the Platform after any such changes constitutes your acceptance of the new terms.
